Terms of Service

1. About These Terms

EdSoft (PTY) LTD ("EdSoft", "we", "us", or "our"), a company registered in South Africa (Registration Number: 2024 / 540233 / 07), operates the EdSoft platform at edsoft.org. These Terms of Service govern your use of our platform and the purchase of our educational modules.

2. Acceptance of Terms

By accessing or using EdSoft you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the platform.

3. Account Registration

You must create an account to purchase or access modules. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and current information during registration. You must be at least 18 years old to create an account.

Account holders may create learner profiles for children or students under their account. A learner profile contains only a first name and is used solely to track module progress. By creating a learner profile, the account holder confirms they have the legal authority to do so — either as a parent or guardian, or as an educational institution acting in accordance with applicable law.

4. Institutional and School Accounts

Schools and other educational institutions may purchase module access on behalf of their learners. Institutional accounts are subject to the same Terms as individual accounts, with the following additions:

• The institution is the account holder and is responsible for all activity under the account, including all learner profiles created
• Module access granted under an institutional account is for the learners of that institution only and may not be transferred to individuals outside the institution
• The institution is responsible for ensuring that its use of the platform complies with all applicable education, data protection, and privacy laws

5. Purchases and Payment

All purchases on the EdSoft platform are processed by Paddle.com Market Limited ("Paddle"), an Irish-incorporated entity, which acts as the Merchant of Record for all transactions. By completing a purchase you also agree to Paddle's Terms of Service and Paddle's Privacy Policy. Prices are displayed inclusive of applicable taxes where required by law. Payment is due in full at the time of purchase.

6. Module Access

Upon successful payment, you are granted a personal, non-exclusive, non-transferable licence to access and use the purchased module(s) for your own personal, non-commercial educational purposes. You may not share, sublicence, resell, redistribute, or provide access to any module to any third party.

7. Free Modules

Certain modules are available at no charge. These are added to your account immediately upon request and are subject to the same licence terms as paid modules. No payment information is required to access a free module.

8. Intellectual Property

All content on the EdSoft platform, including but not limited to text, graphics, videos, audio, and educational materials, is owned by or licenced to EdSoft (PTY) LTD and is protected by applicable intellectual property laws. You may not reproduce, distribute, publicly display, or create derivative works from any content without our express written permission.

9. Prohibited Conduct

You may not:

• Use the platform for any unlawful purpose or in violation of any applicable law
• Share your account credentials or grant access to your purchased modules to others
• Attempt to gain unauthorised access to any part of the platform or its infrastructure
• Use automated tools, bots, or scrapers to access platform content
• Infringe upon the intellectual property rights of EdSoft or any third party
• Upload or transmit any malicious code, spam, or harmful content

10. Refunds

Our refund policy is set out in full at edsoft.org/refund-policy. Refunds are processed automatically where eligibility criteria are met.

11. Disclaimer of Warranties

The EdSoft platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by South African law, EdSoft (PTY) LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform or any purchased module. Our total liability to you shall not exceed the amount paid by you for the relevant module in the 12 months preceding the claim.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of any material changes by email at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes your acceptance of the updated Terms.
